Someone told me that the citizens advice told them that they were entitled to terminate any further H.P payments for their car as long as they have paid half. They have had a long running battle with the garage they purchased their car from regarding repairs under guarentee etc. They have paid half now and are considering not paying any more. I not sure if this can be legal, does anyone know ?? (wasn't sure which section this should have gone in)

they should read the terms of the contract. Some allow the car to be returned once half the payments have been made, but it depends on the agreement.
you cant keep the car and just refuse payments. That would be breach of contract and the company could then take it to court

They are fed up of the said garage fobbing them off, mechanical faults keeps cropping up and the garage keep fobbing them off, even though it has a service and repair guarentee, so they just intend to cut their losses and reurn the car
Can't they go to the Trading Standards dept at the council and they
could hopefully sort it out , worth a try .
presumably the CAB have looked at the contract and have advised them accordingly. They now need to make the finance company aware.

Did they ever think to contact the finance company about the problems they were having
If the garage is not sorting the problems out , they are in breach of
contract , and i'm sure Trading Standards are the people to contact .
